Welcome to the world of Scrap dealing scammers who will steal you blind given half a chance.  Garcia's Surplus is a leader in the business!

E-mail address:  Nickeygarcia1@aim.com (this e-mail will be directed to the real account - yet to be determined - to be posted here when available)

The story:

Our company had decided to discontinue a portion of our business which would result in some excess equipment that we no longer needed for production purposes.  We decided that we would sell that equipment to recoup as much money as possible.  In comes Louie and Nickey Garcia.  They viewed our operation and wanted to make a "quick" purchase with a lot of pressure to sell something to them right away.  We concentrated on one area with copper, brass, and steel worth about $25 - $30 thousand dollars.  We were willing to accept a lower dollar amount for the sale because they would be doing the difficult work of removing the equipment.  The agreed upon price was $23,000 after we threw in an old truck we no longer needed or wanted (valued at around $1,500).  They enthusiastically shook hands and paid us $4,000 in cash as a down payment with the balance to be paid that Friday (witnessed by several people in the company so there was no funny business going on).  They began work within minutes.  It was quickly obvious to us that they had no intention of removing the equipment for selling it elsewhere.  They were pulling out the most valuable portions, the brass and copper, so they could sell it for scrap value (estimated at $14,000).  They loaded up their truck with that material.  I took the above picture of the outside of their truck because I did not trust them and had another individual they did not know pretend to go outside on business and take the picture of the license plate.  I then required at least one of the people to give me his California Drivers License to make a photo copy to ensure some protection for our company.  They argued over this for about 20 minutes because they are "honest business men" and they've "never done business like this" where they were treated so poorly.  However, Nickey Garcia finally did provide a drivers license which we do have on file.

These two men returned the following two days removing the copper and brass.  The third day was Friday, which was the day they were expected to pay the balance of the money owed to our company.  They did not have the money.  They were going to have their "girl" bring by a check.  Then they wanted to buy some of our scrap brass chips.  They even offered to purchase some inferior brass scrap chips at a much higher price than it was worth.  They were told they could only have the brass chips when the check to pay the balance they owed PLUS the amount to cover the brass chips they wanted was received.  They were not allowed to leave the property with anything else.  They left and never returned.

Phone calls on that Friday were returned by "Nickey" by saying that his "brother" Louie was on his way with the check.  He never arrived.

Phone calls the following Monday were not quickly answered.  When they were finally answered, the story was that their "Uncle" had died and they were taking care of things.  By Wednesday, they were going to have services through that Friday and we would hear back from them that Friday.  Didn't happen.

The VP of our company called "Nickey" 9 times consecutively on his cell phone the following Monday.  Every time it went to Voice Mail, he hung up and redialed.  Finally "Nickey" answered and said he'd just woken up and would have his "brother" Louie call us back.  Never happened.  Then we contacted a Sheriff friend.

Hello Nickey and Louie.  Hope you read that last part.

We have a signature from Louie.  We have Nickey's CDL.  We have Louie's license plate number.  And we have an OUTSIDE person who will SWEAR in court the value of what was removed from our company.  And guess what?  Grand Theft and Grand Theft with Fraud will be the results.

Personally, I'd rather these two pieces of garbage rot in prison than get the money.

If these two guys come to your business offering money (even fair money) for something, make sure you get 100% in advance.

And no, this website isn't going away.

It will be here to help protect others to prevent more robbery from these con artists.

For as long as I can afford a domain name at $5.99 per year.  And I think that will be a very long time.
